Terms of use for our accounts and tax software.
These terms apply when you use Deplexify's accounts and tax software at tools.deplexify.com (“the software”). The software is provided by Glenn Broome, Chartered Accountant, trading as Deplexify (“we”, “us”). If you also engage us to do accounting work, that engagement letter applies as well, and wins if the two differ.
1. What the software does
- It prepares accounts, tax computations and tax returns from the records you give it.
- Where you choose, it sends information to HM Revenue & Customs (HMRC) under Making Tax Digital for Income Tax: quarterly updates, year-end submissions, other income and reliefs, and the final declaration.
- It shows you HMRC's replies, the quarters HMRC expects, and HMRC's tax calculations.
2. Who may use it
Accounting firms and agents acting for their clients, and individuals managing their own tax affairs. You must have an account that we have set up for you.
3. Connecting to HMRC
- You connect the software to HMRC by signing in on HMRC's own website. HMRC then gives the software authority for up to 18 months. We never see your HMRC password.
- You can disconnect in the software at any time. You can also remove the authority through your HMRC account.
- Agents: you may send information for a client only after the client has authorised you through HMRC. You must also have your client's agreement to everything you send for them.
4. Your responsibilities
- The records you give the software must be complete and correct.
- Check each update, submission and declaration before you send it. The software shows it to you, and checks it against HMRC's rules, before it goes.
- The final declaration is a legal statement to HMRC. Make it only when the taxpayer has confirmed the information is correct and complete.
- Keep your sign-in details and devices secure, and tell us at once if you think someone else has used them.
- Do not use the software for anything unlawful, or try to get into data that is not yours.
5. Our responsibilities
- We provide the software with reasonable skill and care, and keep it up to date with HMRC's requirements.
- We send fraud prevention data to HMRC with every call, as the law requires (see the software privacy policy).
- We tell you when HMRC accepts or rejects what you send, and why.
6. Availability
We aim to keep the software available at all times, but we cannot promise it will never be interrupted, for example during maintenance or when HMRC's services are down. Leave time before HMRC's deadlines.
7. Fees
Fees, if any, are as agreed with us in writing before you start.
8. Liability
- We are not responsible for tax, interest or penalties caused by information you gave us that was incomplete or wrong, or by something you sent without checking.
- We are not responsible for losses caused by HMRC's systems being unavailable.
- Nothing in these terms limits liability that the law does not allow us to limit.
9. Your data
Your records stay yours. We use them only to provide the software and as our software privacy policy explains. When an accounting firm uses the software for its clients, we process the clients' data on the firm's behalf.
10. Ending
You can stop using the software at any time. We may suspend or end access if these terms are broken, after telling you why where we can. When access ends, we return or delete your data as you ask, apart from records we must keep by law.
11. Changes and the law
We may update these terms. We will tell you about important changes before they apply. These terms are governed by the law of England and Wales.
